A.D.R.

The acronym A.D.R. stands for Alternative Dispute Resolution and it encompasses all those procedures that are meant to find out-of-court solutions to a dispute.  In Italy, this category currently includes mediation (governed by Legislative Decree no. 28 of March 4^th 2010), the so-called “counselled negotiation” (which is a form of settlement negotiation that calls for the presence of legal counsel under Law Decree no. 132 of Sept. 12^th 2014, as subsequently amended under Law no. 162 of Nov. 10^th 2014), and arbitration.

When asked to offer our services in connection with a dispute, it is our policy to always assess the possibility of finding an out-of-court settlement.  Over the years, through the focused study of A.D.R. procedures we have developed familiarity with negotiation tools, with the dynamics most frequently encountered in disputes of a predominantly financial nature, and with the considerations that often guide the parties’ conduct in the stages preceding the commencement of litigation.

Hence, not only are we available to counsel and assist our clients in connection to A.D.R. procedures, but we ourselves try to promote A.D.R. whenever we deem that a settlement could be in the client’s best interest.
